Terms of service

These Terms of Service (“Terms”) govern your access to and use of the websites, applications, products, platforms, and services provided by Typograph (“Typograph,” “we,” “us,” or “our”), including but not limited to subscription-based website design, hosting, maintenance, subsidiaries access affiliate entities (collectively, the “Services”).
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Services.
1. Definitions
To ensure clarity and reduce ambiguity, the following definitions apply throughout these Terms:
- “Account” means the user account registered with Typograph.
- “Agency” means a business or individual approved to resell Typograph Services under a white-label arrangement.
- “Client Content” means any content provided by you or your clients, including text, images, videos, logos, and branding assets.
- “End Client” means a third party receiving Services via an Agency.
- “Subscription” means a recurring payment plan for Services.
- “Services” means all Typograph offerings, including website design, hosting, maintenance, dashboards, and support.
- “You” or “User” means the individual or entity accessing or using the Services.
2. Eligibility and Authority
2.1 Minimum Age
You must be at least eighteen (18) years old or the age of legal majority in your jurisdiction to use the Services.
2.2 Authority to Bind an Entity
If you use the Services on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms.
2.3 Compliance With Laws
You are responsible for ensuring that your use of the Services complies with all applicable laws, regulations, and industry standards.
3. Scope of Services
3.1 Subscription-Based Model
Typograph provides Services exclusively on a subscription and a time basis unless otherwise stated in writing.
3.2 Services Included
Depending on your plan, Services may include:
- Website design and layout
- Hosting and infrastructure
- Ongoing maintenance and updates
- Technical support
- Delivery for Agencies
3.3 No Guarantee of Specific Results
While Typograph strives to deliver high-quality Services, we do not guarantee specific business outcomes, rankings, traffic levels, or conversions.
4. Account Registration and Security
4.1 Account Creation
You must provide accurate, current, and complete information when creating an Account.
4.2 Account Security
You are responsible for:
- Maintaining confidentiality of login credentials
- All activities occurring under your Account
Typograph is not liable for unauthorized access caused by your failure to safeguard credentials.
4.3 Account Suspension
We reserve the right to suspend or restrict Accounts that appear compromised or are used in violation of these Terms.
5. Subscriptions, Fees, and Payments
5.1 Billing
Subscriptions are billed in advance on a recurring basis (monthly or annually).
5.2 Payment Processing
Payments are processed through third-party payment providers. Typograph does not store full payment card details.
5.3 Failed Payments
Failure to process payment may result in:
- Service suspension
- Loss of access
- Termination of Account
5.4 Price Changes
Typograph may modify pricing with reasonable notice. Changes apply at renewal unless otherwise stated.
5.5 No Refunds
Except where required by law, and for some certain products or service clearly stated at checkout.
6. Client Content and Intellectual Property
6.1 Ownership
You retain ownership of Client Content you submit.
6.2 License to Typograph
You grant Typograph a worldwide, non-exclusive, royalty-free license to host, display, modify, and distribute Client Content solely to provide the Services.
6.3 Typograph Intellectual Property
All Typograph software, designs, templates, systems, and processes remain the exclusive property of Typograph.
7. Acceptable Use Policy
You agree not to use the Services to:
- Violate any law or regulation
- Infringe intellectual property rights
- Distribute malware or harmful code
- Host illegal, deceptive, or abusive content
- Interfere with system integrity
Typograph reserves the right to remove content or suspend Accounts violating these rules.
8. Agency Services
8.1 Agency Responsibilities
Agencies are solely responsible for:
- Their End Clients
- Client communications and contracts
- Obtaining lawful consent for data processing
8.2 White-Label Nature
Typograph may remain invisible to End Clients. Agencies may not disclose Typograph as the underlying provider without permission.
8.3 Liability Allocation
Agencies assume full responsibility for End Client claims arising from Agency-branded services.
9. Support and Service Availability
9.1 Support Scope
Support is provided according to your Subscription plan.
9.2 No Uptime Guarantee
Services are provided “as-is” without guarantees of uninterrupted availability.
10. Feedback
Any feedback you provide may be used by Typograph without restriction or compensation.
11. Termination and Suspension
11.1 Termination by User
You may cancel your Subscription at any time. Services remain active until the end of the billing period.
11.2 Termination by Typograph
We may suspend or terminate access for:
- Violation of these Terms
- Legal compliance reasons
- Security threats
11.3 Effect of Termination
Upon termination:
- Access to Services ceases
- Data may be deleted per our retention policy
12. Data Handling and Privacy
Personal data is handled in accordance with the Typograph Privacy Policy, which is incorporated by reference.
13. Disclaimers
14. Limitation of Liability
To the maximum extent permitted by law:
- Typograph is not liable for indirect, incidental, or consequential damages
- Total liability is limited to fees paid in the preceding twelve (12) months
15. Indemnification
You agree to indemnify and hold harmless Typograph from claims arising out of:
- Your use of the Services
- Client Content
- Violations of these Terms
16. Governing Law and Dispute Resolution
17. Force Majeure
Typograph is not liable for delays or failures caused by events beyond reasonable control.
18. Assignment
You may not assign these Terms without prior written consent. Typograph may assign freely.
19. Severability
If any provision is found unenforceable, the remaining provisions remain in effect.
20. Entire Agreement
These Terms constitute the entire agreement between you and Typograph regarding the Services.
21. Changes to These Terms
Typograph may update these Terms at any time. Continued use constitutes acceptance.
